DMCA Policy
Last updated: December 2024
Introduction
Blogees ("we", "us", "our", or "the Platform") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), Blogees will respond promptly to valid infringement notices and remove or disable access to content that allegedly infringes copyright.
This DMCA Policy outlines the procedures for reporting copyright infringement on our platform and our process for responding to valid takedown notices. We have adopted a policy of terminating, in appropriate circumstances, users who are repeat infringers.
Copyright Infringement Notification (DMCA Takedown Notice)
If you believe that content published on Blogees infringes your copyright, you must submit a written notification that includes all of the following information (pursuant to 17 U.S.C. § 512(c)(3)):
- •Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or if multiple works are covered by a single notification, a representative list of such works
- •Identification of the infringing material with sufficient detail:
- ◦Exact URL of the content within Blogees
- ◦Screenshot or clear description of the material
- •Claimant contact information:
- ◦Full name
- ◦Physical address
- ◦Email address
- ◦Telephone number
- •Good faith statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
- •Accuracy statement: A statement that the information provided is accurate and that the claimant is the copyright owner or is authorized to act on behalf of the owner of the allegedly infringed right
- •Physical or electronic signature: Physical or electronic signature of the copyright owner or their authorized representative
How to Submit a DMCA Takedown Notice
You can submit your DMCA takedown notice to our designated Copyright Agent:
DMCA Agent: Blogees Legal Department
Email: dmca@blogees.com
(If this email is not yet available, you may temporarily use support@blogees.com)
Address: San Francisco, CA, United States
⚠️ Important: Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability, including damages and attorney fees. We recommend consulting with an attorney before filing a DMCA notice.
Blogees Response Procedure to DMCA Notices
When Blogees receives a valid DMCA takedown notice, we will:
- •Evaluate the request: Review the notice to ensure it meets DMCA requirements
- •Remove or disable access: Temporarily remove or disable access to the allegedly infringing material
- •Notify the user: Inform the user responsible for the content, indicating:
- ◦What content was removed
- ◦Why it was removed
- ◦That they may file a DMCA counter-notice if they believe it was an error
- •Provide a copy: Provide the user with a copy of the takedown notice, including the contact information of the complainant
We typically process valid DMCA notices within 24-48 hours of receipt. Blogees may suspend users who repeatedly violate copyright on a recurring basis.
Counter-Notification (DMCA Counter Notice)
If you are the affected user and believe that the removal was an error or that you have legal permission to use the content, you may submit a counter-notification. To be valid, your counter-notice must include:
- •Identification of the removed material: Identification of the content that was removed and its previous location on Blogees
- •Your contact information: Your name, address, email address, and telephone number
- •Good faith statement: A statement, under penalty of perjury, that you have a good faith belief that the removal of the content was due to an error or misidentification
- •Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district corresponding to your address (or, if you are outside the United States, the jurisdiction of the district where Blogees or its hosting provider is located)
- •Physical or electronic signature: Physical or electronic signature of the sender
Submit your counter-notice to: dmca@blogees.com
Counter-Notice Process
Once a valid counter-notice is received:
- •Blogees will forward the counter-notice to the original claimant
- •We will inform them that we will restore the removed content or cease disabling access to it in 10-14 business days
- •If the claimant does not file a legal action within 10-14 days, Blogees may restore the content
- •We will not restore the content if our Copyright Agent receives notice that the original complainant has filed a court action seeking an injunction against the user
User Responsibility
Users are fully responsible for the content they publish. Publishing copyrighted content without permission may result in:
- •Removal of the content
- •Suspension or closure of the account
- •Legal actions by the rights holder
Blogees is not responsible for user-uploaded content, provided that we act in accordance with the DMCA and promptly remove reported material.
Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, Blogees has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers.
Blogees may suspend or permanently cancel accounts of users who:
- •Receive multiple infringement notices
- •Repeatedly or deliberately publish protected content
- •Demonstrate a pattern of copyright infringement
We may also, at our sole discretion, limit access to the platform and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
False Claims and Legal Liability
⚠️ Warning: Legal Consequences
